GENERAL
This website (www.welastransport.com) is operated by WELAS Transport LLC. Throughout the site, the terms “we”, “us” and “our” refer to WELAS Transport LLC.
This Agreement sets forth the terms and conditions between WELAS Transport LLC and users who use our website to buy/reserve our tours, excursions and/or transportation services (“YOU”) may those tours be operated by WELAS Transport LLC or any individual who provides tours and/or transportation services (“OPERATORS”). This Agreement explains how YOU purchase tours, excursions and/or transportation services and specifically limits the liability of WELAS Transport LLC. By visiting our site and/ or purchasing something from us, you engage in our “Service” and agree to be bound by the following terms and conditions (“Terms of Service”, “Terms”), including those additional terms and conditions and policies referenced herein and/or available by hyperlink. These Terms of Service apply to all users of the site, including without limitation users who are browsers, vendors, customers, merchants, and/or contributors of content. You must read this Agreement before using the Site and booking a service. Use of the Site constitutes an agreement to all terms and conditions in this Agreement and YOU warrant that you understand, agree to, and accept all terms and conditions contained here.

WELAS Transport LLC, a Puerto Rico corporation with its principal place of business in Añasco, Puerto Rico, gives notice that some services provided in connection with these itineraries are rendered by suppliers who are not agents or employees of WELAS Transport LLC. WELAS Transport LLC, its owners, guides, drivers, and employees shall not be responsible for any injuries, losses, or damages in connection with terrorist activities, social or labor unrest, political disputes, failure of the mechanical or structural integrity of air, sea, and ground transportation and accommodations, diseases, local laws, kidnapping, climatic conditions, acts of God, delays, changes or cancellation of travel due to weather conditions, hotel services, accidents or health-related problems before or while in-transit to (e.g., an accident on the way to a tour), during, and after a tour, flight changes or cancellation, missed connections, or any other actions, omissions, or conditions outside of WELAS Transport LLC's control. By embarking upon his/her travel, the traveler voluntarily assumes all risks involved in such travel, whether expected or unexpected. Traveler is hereby warned of the above risks as well as possible medical and climatic disruptions, and the possibility traveler may be unable to travel as scheduled because of personal emergency.
WELAS Transport LLC provides and connects YOU with tours, excursions, adventures, and/or transportation services operated by WELAS Transport LLC and/or other OPERATORS, who are seeking to provide tours, adventures, and transportation related services. We do this through our website, www.welastransport.com (“Site”), which is a descriptive forum of the services operated by WELAS Transport LLC and OPERATORS.
YOU understand that the OPERATORS presented on the Site are independent contractors and that the OPERATORS are not employees or agents of WELAS Transport LLC. YOU hereby understand and expressly agree that WELAS Transport LLC does not control the quality, timing, legality, or any other aspect whatsoever of the services delivered by the OPERATORS, other than WELAS Transport LLC, nor of the integrity, responsibility, or any of the actions whatsoever of the OPERATORS.
WELAS Transport LLC and its owners, guides, drivers, and employees are not qualified first aid or medical care providers and can assume no liability to provide first aid or medical care.
WELAS Transport LLC reserves the right to decline, accept, or to retain and disqualify from the entire trip, or any portion of the trip, any person whose conduct or physical health impedes trip operation or infringes on the rights, welfare, or enjoyment of other trip members. A refund for unused services will not be given under such circumstances.
Copyright and Ownership
All the content featured or displayed on the Service, including without limitation text, graphics, photographs, images, sound, and illustrations ("Content"), is owned by WELAS Transport, its licensors, vendors, agents, or its Content providers. All elements of the Service, including without limitation the general design and the Content, are protected by trade dress, copyright, moral rights, trademark, and other laws relating to intellectual property rights. The Service may only be used for the intended purpose for which such Service is being made available. You are authorized to view, play, print, and download copyrighted documents, audio, and video found on our Service for personal, informational, and non-commercial purposes only. You may not modify any of the materials and you may not copy, distribute, transmit, display, perform, reproduce, publish, license, create derivative works from, transfer, or sell any information or work contained in the Service. The Service, its Content, and all related rights shall remain the exclusive property of WELAS Transport or its licensors unless otherwise expressly agreed. You will not remove any copyright, trademark, or other proprietary notices from material found on the Service.
Trademarks; No Endorsement.
All trademarks, service marks, and trade names of WELAS Transport LLC used in the Service (including but not limited to WELAS Transport LLC name and logo; the Service's name, design, and any logos) (collectively "Marks") are trademarks of WELAS Transport LLC or its affiliates, partners, vendors, or licensors. You may not use, copy, reproduce, republish, upload, post, transmit, distribute, or modify the Marks in any way, including in advertising or publicity pertaining to the distribution of materials on the Service, without WELAS Transport LLC’s prior written consent. WELAS Transport LLC prohibits the use of Marks as a "hot" link on or to any other website unless the establishment of such a link is approved in advance. You shall not use WELAS Transport LLC’s name or any language, pictures, or symbols which could, in WELAS Transport LLC’s judgment, imply WELAS Transport LLC endorsement in any written or oral advertising, presentation, brochure, newsletter, book, or other written material of whatever nature, without prior written consent.
WELAS Transport LLC does not control any Provider or any product or service. You are responsible for determining the appropriateness and suitability of any prospective Provider or any activity booked through this Service.
Inappropriate Material. You are prohibited from using the Service to post or send any unlawful, threatening, defamatory, libelous, obscene, pornographic, or profane material or any material that could constitute or encourage conduct that would be considered a criminal offense or give rise to civil liability, or otherwise violate any law. In addition to any remedies that we may have at law or in equity, if we determine, in our sole discretion, that you have violated or are likely to violate the foregoing prohibitions, we may take any action we deem necessary to cure or prevent the violation. We may fully cooperate with any law enforcement authorities or court order or subpoena requesting or directing us to disclose the identity of anyone inappropriately using the Service.
Privacy. Data collection and use, including the collection and use of personally identifiable information, is governed by WELAS Transport LLC Privacy Policy which is incorporated into and is a part of this Agreement.
NON-SMOKING POLICY
All WELAS Transport LLC’s transportation services are strictly non-smoking. WELAS Transport LLC forbids smoking inside any vehicle or while conducting a tour and/or service. Smoking is only allowed in an outdoor public place during your scheduled leisure time.
MEDIA RELEASE
We will be taking random pictures of you, the group, and the sites we visit. Any pictures taken during the trip can be used for promotional purposes. If you wish not to have your picture taken, please let us know, prior to check-in, via email at hello@welastransport.com.
DATA PROTECTION ACT
It may be necessary for the Company to ask you for certain personal information. Examples of this would be dietary requirements, disability/medical or religious information, etc. This information will be kept confidential by the Company and is available to you to inspect during the Company’s normal working hours. It will be passed to the suppliers if it is necessary for them to know this information to fulfill the Company’s contract with you.
PARTICIPANT RESPONSIBILITIES
Every client is responsible for comprehending the conditions stated and implied in their trip description/itinerary and for selecting a trip that is appropriate to his/her interest(s) and abilities; for disclosing in writing and/or phone or email, any potentially relevant medical or health conditions to WELAS Transport LLC; for preparing for the trip by reading the trip itinerary(ies) and all supplemental trip information supplied by WELAS Transport LLC or other relevant suppliers; for discussing this itinerary with their physician; for bringing appropriate clothing and gear/equipment as instructed; for following normal standards of personal hygiene and personal safety as advised by the trip leader, local guides, and/or WELAS Transport LLC, in order to lessen the risk of travelers’ diseases or injuries; for adhering to the reasonable directives of the tour leader and/or local guide(s); for acting in an appropriate social manner with fellow trip members when on a group trip; for acting in an appropriate and respectful manner in accordance with the customs of the places visited on each and every trip; and for completing the trip itinerary when traveling on group programs.
PRICING
Prices are per person (unless stated otherwise) and are quoted in U.S. Dollars. Please consult the itinerary provided for further information on what your trip includes. Not included in the price are: items not mentioned in the agreed plan, items of a personal nature such as gifts, souvenirs, additional meals or beverages not included in the trip, excess baggage, medical costs, the costs of hospitalization and evacuation from remote areas, and additional expenses arising from delays or extension of a trip due to weather, political dispute, sickness, failure of transportation or other causes beyond WELAS Transport LLC’s control, tips for guides, drivers, and restaurant servers, and, any optional excursions.
PAYMENT
To secure your space, payment in full and/or a deposit is due upon booking. All payments are to be made to WELAS Transport LLC through the secure e-commerce interface and/or payment instruments provided at checkout. Your reservation may be canceled (in some cases automatically) if payment is not received by the indicated due date. The payment for a reservation on the chosen service shall constitute consent to all provisions of this WELAS TRANSPORT LLC TERMS & CONDITIONS statement as well as the provisions listed in the RELEASE OF LIABILITY, WAIVER, INDEMNIFICATION, AND ASSUMPTION OF RISKS and TRIP-SPECIFIC POLICY ON PAYMENTS, CANCELLATIONS & REFUNDS documents, as well as all provisions contained in any brochures, trip descriptions, and/or itineraries, or other forms of collateral provided to the client in conjunction with a booking. These provisions are hereby incorporated by reference in this Disclosure Notice and clients are advised to take note of them.
DEPOSITS, REFUNDS, CANCELLATIONS, AND CHANGES
Notice of change or cancellations must be sent to WELAS Transport LLC in writing via email to hello@welastransport.com or by calling (787) 922-1542 and acknowledged by WELAS Transport LLC.
Refund
Reservations of nine or fewer guests: If a customer cancels their service at least 72 hours before the scheduled start time, they are eligible for a refund.
Bookings for ten or more people: If a customer cancels their service at least seven days before the scheduled start time, they are eligible for a refund.
No Refund
Refunds are not available for cancellations made fewer than 72 hours (7 days for parties of 10 or more) prior to the service date. There is no refund for arriving late, leaving a trip early, or “no shows”. Exceptions to this policy cannot be made for any reason, including but not limited to weather or personal emergencies.
We are forced to remain firm about our cancellation policy. Considering that on the day of any confirmed service, we will be there, on-site, waiting, and ready to serve the guests. Regardless of the cancellation reason, our time and fixed costs are already invested; we may even have turned down other customers by holding a particular guest space.
Non-Refundable
Credit card processing fees and service fees are non-refundable.
Refunds for Tour Cancellations by the Operator
In the rare event that WELAS Transport, LLC must cancel a tour due to unforeseen circumstances (e.g., weather conditions, safety concerns), customers will receive a full refund or the option to reschedule.
Refund Process
Refunds, when applicable, will be processed within five days to the original payment method.
Minimum Participation Requirements
Some tours may have minimum participation requirements. If these requirements are not met, WELAS Transport, LLC reserves the right to cancel the tour. Customers will be notified at least 24 hours in advance, and a full refund will be provided.
Deposits
A 50% non-refundable deposit may be required to secure a booking for some of our services. The amount of the deposit will vary depending on the type of service booked and will be communicated to the customer at the time of booking. The deposit serves as a commitment from the customer to proceed with the booking and secures their reservation. By paying the non-refundable deposit, customers acknowledge and accept the terms of our policy.
Deposit Refunds
The deposit is non-transferable and non-refundable under any circumstances, including but not limited to cancellations, changes in plans, or no-shows.
Custom Tours or Special Events
For custom tours that require a reservation with another tour operator, different cancellation policies may apply and will be communicated to the customer at the time of booking.
Force Majeure
The tour guide operator is not liable for cancellations or changes beyond their control, such as acts of nature, government restrictions, or other force majeure events.
Before tour commencement, WELAS Transport LLC and the OPERATOR may ask YOU to sign a RELEASE OF LIABILITY, WAIVER, INDEMNIFICATION, AND ASSUMPTION OF RISKS document before providing service. If these are not submitted, you will not be able to acquire the service(s) booked for and you will be subject to WELAS Transport LLC cancellation policy.
LEGAL CLAIMS
For all disputes between WELAS Transport, LLC and YOU relating to the Site, this Agreement, transactions facilitated or conducted through the Site, tours and transportation services ordered or purchased through the Site, dealings between YOU and WELAS TRANSPORT, LLC, dealing between YOU and OPERATORS, or any related matters (“Claims”), the parties will attempt to find the least onerous solution to the Claims. If a Claim cannot be resolved by the parties, then the Claim must be resolved by a legal mediator and/or before the courts of the Commonwealth of Puerto Rico, and YOU hereby irrevocably submit and attorn to the exclusive jurisdiction of the courts of the Commonwealth of Puerto Rico in respect of all Claims. Proceedings regarding Claims must be commenced in a court of competent jurisdiction in the Town of Añasco, Puerto Rico, within three (3) months after the Claim arose. Any shorter time limit provided by statute or other law remains unaffected.
CHANGES TO TERMS OF SERVICE
You can review the most current version of the Terms of Service at any time on this page. We reserve the right, at our sole discretion, to update, change or replace any part of these Terms of Service by posting updates and changes to our website. It is your responsibility to check our website periodically for changes. Your continued use of or access to our website or the Service following the posting of any changes to these Terms of Service constitutes acceptance of those changes.
WELAS Transport LLC reserves the right to substitute accommodation or change schedules without prior notice should circumstances so demand. If circumstances require a change in services, WELAS Transport LLC will make every effort to select alternative accommodations of comparable quality, category, and/or value (if available) and to keep the itinerary modifications as minimal as possible under said circumstances. The right is reserved to cancel a trip outright due to low passenger sign-up numbers, illness of a service provider, supplier default, or any other circumstances beyond the control of WELAS Transport LLC. On the rare occasion when WELAS Transport LLC must cancel a service, the payment received will be refunded, which constitutes a full settlement. WELAS Transport LLC is not responsible for expenses incurred in preparation for any canceled trips, such as airline tickets, or for costs incurred due to travel delays, flight cancellations, or illness.
I acknowledge that I have carefully read the above paragraphs, including the information regarding cancellations and refunds, and agree to all stated conditions therein. I DO HEREBY EXPRESSLY AGREE TO FOREVER RELEASE, DISCHARGE AND HOLD WELAS Transport LLC and its owners, employees, officers, directors, associates, suppliers, affiliated companies, and subcontractors HARMLESS against any and all liability, actions, causes of action, debts, suits, claims, and demands of any and every kind and nature whatsoever which I now have or which may hereafter arise out of or in connection with my trip or participation in any activities arranged for me by WELAS Transport LLC and its owner, employees, associates, suppliers, affiliated companies, or subcontractors. THE TERMS OF THIS AGREEMENT SHALL SERVE AS A COMPLETE RELEASE AND EXPRESS ASSUMPTION OF RISK for myself, my heirs, assignees, administrators, executors, and all members of my family, including any minors accompanying me.
